Q.

(20 marks, 2013 Q2)
A.
Second Class Magistrates are not commonly appointed nowadays.
Small Claim Court (Small Claim Procedure)
Small Claim Court is not entirely correct because it is not a Court by itself. It is a Division under Magistrates' Court. So, it is not a Court but a Procedure.
Where to smooth things faster and less cost to the process of dispute settlement, Small Claim Court is another avenue.
In Small Claim Court, A Second Class Magistrate presides over the dispute without any counsel for both parties. The amount in dispute should not exceed RM5,000.
